HostifyPlus Terms and Conditions – Version 1.0

1. General / Scope

1.1. These terms and conditions apply to the agreement between HostifyPlus (hereinafter referred to as “HostifyPlus”, “we”, “us”, or “our”) and you, the customer (“you”, “your”, “client”), for the registration, hosting, and management of domains and related services.

1.2. By using our services, you agree to comply with these Terms and Conditions, as well as any relevant policies, including those set by ICANN and other applicable registries. These terms govern all domain registrations and hosting services offered by HostifyPlus.

1.3. HostifyPlus reserves the right to amend these Terms and Conditions at any time. Any changes will take effect immediately upon publication on our website. It is your responsibility to check this page regularly for updates.

2. Acceptable Use Policy

2.1. Misuse of Servers: The content placed on your website must adhere to common societal norms. Websites with inappropriate content, including adult material or content that encourages illegal activities, are strictly prohibited. HostifyPlus has the right to assess the acceptability of any website hosted on our servers. If your website is found to violate these standards, we reserve the right to take it offline. In cases of suspected criminal activity, we may also notify the relevant authorities and provide them with necessary data.

2.2. Spam Prohibition: Sending large volumes of unsolicited email (spam) via HostifyPlus servers is strictly prohibited. Should we detect any violation of this policy, we reserve the right to immediately suspend or remove your website from the internet without prior notice.

2.3. Data Traffic: HostifyPlus provides its customers with unlimited data traffic based on a ‘fair use policy.’ This means that your data usage should be in line with the average traffic usage of other websites. If your website generates an unusually high volume of traffic that exceeds this average, we will issue a warning. Should this exceed acceptable levels, we reserve the right to take action, including imposing an additional charge for the excessive data usage.

3. Definitions

Registrar: HostifyPlus acts as an intermediary between you and the relevant registry, managing domain registration and maintenance.
Registrant: Any individual or legal entity who registers a domain name for their own use.
Registry: The organization responsible for managing and maintaining the Top-Level Domain (TLD) under which your domain is registered.
ICANN: The Internet Corporation for Assigned Names and Numbers, the global authority responsible for coordinating domain name systems and IP addresses.
TLD (Top-Level Domain): The suffix at the end of a domain name, such as .com, .net, or .nl.
gTLD: Generic TLDs regulated by ICANN (e.g., .com, .net).
ccTLD: Country-specific TLDs (e.g., .de for Germany, .uk for the United Kingdom).
WHOIS: A publicly accessible database that provides information about registered domain names and their owners.

4. Registration Process

4.1. HostifyPlus provides domain registration services as an intermediary between you and the registry. While we facilitate domain registration, we do not guarantee that the desired domain name will be available or free from third-party claims.

4.2. When registering a domain, you agree to comply with all applicable laws and regulations, including but not limited to ICANN rules, registry-specific policies, and any other legal obligations.

4.3. You acknowledge that your personal data, including contact information, may be stored and processed in accordance with applicable laws. This data may be shared with the registry and other third parties as required for the registration process.

5. Obligations of the Customer

5.1. You are responsible for providing accurate and complete information during the registration process. You agree to update this information as needed to ensure it remains accurate and current.

5.2. You must ensure that any information provided regarding the ownership of the domain is truthful, and if any changes occur, such as changes in address or contact details, you must notify us within 7 days.

5.3. You must comply with all applicable laws, including those related to data protection, consumer protection, and intellectual property rights.

5.4. If you transfer a domain to a third party, you must ensure that you provide accurate contact information and disclose any relevant data to allow for timely resolution of issues that may arise with the domain.

6. Domain Transfers

6.1. To transfer a domain to or from HostifyPlus, you must provide an authorization (AUTH) code and ensure that the domain is unlocked for transfer.

6.2. HostifyPlus may accept or reject domain transfer requests at its discretion. For gTLDs managed by ICANN, you can find the ICANN Transfer Policy here.

7. Domain Renewal

7.1. Domains will automatically renew 1 day before their expiration date. You will receive an email notification 30 days and 7 days prior to expiration. It is your responsibility to ensure that payment is made to keep your domain active.

7.2. If payment for renewal is not received, HostifyPlus reserves the right to delete or suspend the domain. For gTLDs, your domain may be placed in a redemption period, and additional fees may apply to recover it.

8. Warranty Exclusions

8.1. HostifyPlus provides domain names “as is” and does not offer any warranties regarding their availability, functionality, or infringement of third-party rights.

8.2. You agree to indemnify and hold harmless HostifyPlus, the registry, ICANN, and other involved parties from any claims arising from the use of your domain.

9. Dispute Resolution

9.1. Any disputes regarding domain names, including trademark or intellectual property issues, shall be resolved according to ICANN’s Uniform Domain Name Dispute Resolution Policy (UDRP) and Uniform Rapid Suspension System (URS).

9.2. For ccTLDs that do not use the UDRP or URS processes, each registry may have its own dispute resolution procedure, which you must adhere to.

10. Data Protection and Privacy

10.1. HostifyPlus processes personal data in accordance with applicable privacy laws. By using our services, you consent to the collection, use, and sharing of your personal data as outlined in our Privacy Policy.

10.2. You are responsible for informing any third parties whose personal data you provide to HostifyPlus of the disclosure and obtaining their consent for processing.

11. Liability and Force Majeure

11.1. Liability: HostifyPlus makes every effort to provide reliable services, but there are certain situations beyond our control. We work with external parties, and in some cases, the resolution of a problem may lie outside of our reach. While we strive to maintain high standards of service, HostifyPlus will not be held liable for any direct or indirect damages arising from issues outside our control, including but not limited to external server failures, internet outages, or third-party service disruptions.

11.2. If HostifyPlus is found to be liable for any damages, the maximum liability will be limited to the value of the annual subscription fee paid by you, up to a maximum of €300. This limit applies unless the insurer is unable or unwilling to pay the compensation.

11.3. In no case will HostifyPlus be held responsible for any loss of profits, revenue, data, or business opportunities.

12. Applicable Law and Jurisdiction

12.1. These Terms and Conditions are governed by the laws of the Netherlands. Any disputes arising under these terms shall be resolved in the courts of the Netherlands.

13. Amendments

13.1. HostifyPlus reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on this page and will be effective immediately upon publication.
